Terms of Service

Welcome to Varta, a Telegram antispam bot service ("Service," "we," "our," or "us"), operated by "DEEP IN" EDPK (ДИЙП ИН ЕДПК), EIK 208772397, registered in Sofia, Bulgaria. These Terms of Service ("Terms") govern your access to and use of the Varta bot. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

01 Eligibility

You must be at least 16 years of age to use this Service. By using the Service, you represent and warrant that you are at least 16 years old. If you are under 16, you may not use the Service.

02 The Service

Varta is a Software as a Service (SaaS) product designed to help Telegram group and channel administrators detect and moderate spam within their communities using artificial intelligence. The bot processes group messages and content for spam detection.

03 Account and Use of Service

You must be an administrator of a Telegram group or channel to integrate and use the Varta bot. You are responsible for all activities that occur in connection with your group's use of the Service. You agree not to misuse the Service or assist anyone else to do so.

04 Acceptable Use Policy

You agree not to use the Service to:

  • Censor, suppress, or remove legitimate messages or users who are not engaging in spam;
  • Discriminate against users based on race, ethnicity, gender, religion, sexual orientation, disability, or any other protected characteristic;
  • Collect, harvest, or scrape data about group members for purposes unrelated to spam moderation;
  • Engage in or facilitate any unlawful, fraudulent, or abusive activity;
  • Attempt to reverse-engineer, decompile, or otherwise extract the source code or algorithms of the Service;
  • Resell, sublicense, or redistribute access to the Service without our prior written consent; or
  • Interfere with or disrupt the integrity or performance of the Service.

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your access to the Service.

05 Plans, Pricing, and Free Trial

Free Plan: Varta offers a free plan with basic keyword-based spam protection and manual moderation tools. The Free plan is available indefinitely at no cost. AI-powered detection and advanced features require a paid subscription.

5-Day AI Trial: All paid plans include a 5-day free trial with full AI protection. The trial begins only after Varta catches your first spam (so you see value before it starts). Groups that never see spam stay on the Free plan indefinitely at no cost. No payment information is required to start the trial, and it does not auto-renew. After the trial, your plan will revert to the Free plan unless you subscribe to a paid plan.

  • Starter: $19/month
  • Pro: $49/month
  • Business: $99/month
  • Enterprise: Custom pricing (contact us)

Annual Pricing (20% Discount):

  • Starter: $15/month (billed annually at $180)
  • Pro: $39/month (billed annually at $468)
  • Business: $79/month (billed annually at $948)

Member Limits: Member limits are total across all groups and channels associated with your plan. There is no limit on the number of groups or channels you can manage per plan.

AI Checks Usage Limits (per month):

  • Starter: 50,000 AI checks
  • Pro: 250,000 AI checks
  • Business: 1,000,000 AI checks
  • Enterprise: Custom (contact us)

Subscriptions are billed monthly or annually (with discount) and provide access to features as outlined on our pricing page. All payments are processed securely through Stripe. We do not store your sensitive payment information.

06 Cancellation and Refund Policy

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. After the billing period ends, your plan will revert to the Free plan. Refunds for partially used billing periods are not provided.

48-Hour Money-Back Guarantee: If you are not satisfied with the Service, you may request a full refund within 48 hours of your first payment. To request a refund, contact us via the bot or email. Refunds under this guarantee are processed within 5–10 business days.

After the 48-hour window, no refunds will be issued for the current billing period.

07 Termination and Suspension

We reserve the right to suspend or terminate your access to the Service, without prior notice or liability, if you breach these Terms (including the Acceptable Use Policy), use the Service for abusive or unlawful purposes, or fail to pay for your subscription.

Upon termination, your right to use the Service will immediately cease. Your plan will not revert to Free in cases of termination for breach. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

If your access is terminated due to a breach of these Terms, you are not entitled to a refund for any remaining subscription period.

08 Data and Privacy

Our Privacy Policy describes how we handle the information you provide to us when you use our Service.

We process user IDs, usernames, profile metadata, message text (for analysis), group IDs, and admin preferences. Messages are not stored long-term; only flagged content is kept for admin review and is automatically deleted after 90 days. We do not sell any data to third parties. Admin questions submitted through the AI chat feature and suspicious messages are analyzed by AI services (Anthropic, OpenAI, and Google as fallbacks). Screenshots and photos are analyzed for spam detection. Google Safe Browsing API is used to check URLs for known malicious sites.

09 Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Varta and its licensors.

10 Customer References

Varta does not use your community name, logo, or any identifying group metadata on our website, marketing materials, case studies, or social media. Aggregated and anonymized statistics (e.g. "48 active communities", "3.2M messages classified") may be published without identifying any specific group.

To opt IN as a named customer reference (community name, logo, case study), email [email protected] with explicit permission. We only use your community name after a written record of your consent, and you may withdraw that consent at any time — we'll remove the reference within 7 business days.

11 Indemnification

You agree to indemnify, defend, and hold harmless Varta, its owner, affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (i) your use of the Service; (ii) your violation of these Terms; (iii) your violation of any rights of a third party; or (iv) any content or data you provide through the Service. This indemnification obligation will survive the termination of these Terms and your use of the Service.

12 Limitation of Liability

In no event shall Varta, nor its owners, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

To the maximum extent permitted by applicable law, our total cumulative liability to you for all claims arising from or related to the Service shall not exceed the total amount you have paid to us in the twelve (12) months preceding the event giving rise to the claim.

13 Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance. We do not warrant that the Service will detect all spam or that no legitimate messages will be incorrectly flagged.

14 Force Majeure

Varta shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of transportation, facilities, fuel, energy, labor, or materials, failure of third-party services (including but not limited to Telegram API, Anthropic API, OpenAI API, Google API, Stripe, or hosting providers), cyberattacks, government actions, or any other event beyond our reasonable control. During any such period, our obligations under these Terms shall be suspended.

15 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties for a period of 30 days.

If the dispute cannot be resolved through negotiation, it shall be submitted to the competent courts of Sofia, Bulgaria, unless the user is a consumer residing in the European Union, in which case the user may bring proceedings in the courts of their country of residence in accordance with applicable EU consumer protection regulations.

For consumers in the EU, you may also use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr to resolve disputes.

16 Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Bulgaria, without regard to its conflict of law provisions. For users residing in the European Union, mandatory consumer protection laws of your country of residence shall apply to the extent they provide greater protection.

17 Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
